Arora - Health & Wellbeing (a unit of Prajiv Ventures Private Limited (“we“, “our“, or “us“), operates and manages www.arorahw.com. Our aim is to facilitate an affordable and high quality health care service to all users (“user“, “you“, or “your“) by connecting each of you through our Website, to doctors of your choice, and in this regard, if prescribed, assist you to navigate through entire consultation, surgical process, diagnostic process, and/or in recovery procedure, as prescribed by the doctor of your choice, or part thereof (“Services”). These terms govern your use of the Website and Services (“Terms of Use”) and are published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, Privacy Policy and Terms of Use for access or usage of the Website.

By visiting our Website and/or availing any of our Services, it is deemed that you have read and understood the Terms of Use and you are agreeing with the Terms of Use, as well as the Privacy Policy , which is hereby incorporated into these Terms of Use. Eligibility:

Scope of Service:

We facilitate connection between you and the doctor/healthcare provider of your choice through our Website. After you choose a doctor/healthcare provider to provide you health care services, we will facilitate a consultation by you with the doctor/health care provider. Please note that “PRAJIV VENTURES PRIVATE LIMITED ” is not a provider of any health care services, and has no responsibility for delivering any health care services and does not take responsibility whatsoever for facilitation. You agree to assume all responsibility in relation with choosing any doctor/health care provider for your desired procedure. We assume no responsibility or liability for any treatment or other services, health care services rendered by any doctor/healthcare provider , or for any malpractice claims, failure to follow adequate standard of care and/or other claims that may arise directly or indirectly from any such advice, treatment or other services including but not limited to health care services. 3.2. We facilitate for you your treatment(s) at various stages, the Services (including but not limited to)

which we provide through our Website are as follows:

Booking Consultation: We facilitate you to book preliminary consultations with the doctors/healthcare provders of your choice and book subsequent consultations only on your request. We provide you the [Book a Consultation] Service on the profile page of the doctors/health care providers on the Website. To avail this Service, you are required to select consulting hospital of the doctors/surgeons of your choice and pick a time slot of your choice from the available time slots. To confirm the consultation, you are required to provide your email address and mobile phone number. Upon receiving a request, we will confirm the consultation subject to availability of the doctor/surgeon during the selected time slot.
“Ask your healthcare provder” facility: We facilitate you through our Website to connect to doctors/healthcare provider and seek queries of your choice. To avail this Service, you are required to provide your contact information including your email address and mobile phone number along with the query you want to raise to a doctor/surgeon. Upon successful generation of a query, we facilitate you in receiving a response from the doctor/surgeon via messaging application (including but not limited to WhatsApp). Please note that “PRAJIV VENTURES PRIVATE LIMITED ” is not providing any medical advice and/or endorsing any specific doctor/surgeon or medical procedure and we shall not be responsible for any medical advice given by any doctor/health care provider
Get Quotations :We facilitate you through our [Get a Quote] service on our Website, with an estimated quotation of required surgery or medical procedure at various consulting hospitals of the surgeons/doctors specialising in that medical procedure in the selected city (provided the Services are available in the selected city). Please note that the final price may vary from the quotation depending upon the complexities in your treatment, your needs and/or your treatment plan.
Diagnostic Facility: We facilitate you with your diagnostic tests,and as advised by the doctor/healthcare provider you choose. Please note that we do not conduct any diagnostic tests and are not responsible for any sample collected, tests conducted and the accuracy, authenticity and/or correctness of diagnostic test reports.

We facilitate contact with the doctors/healthcare provider , and provide information about them and their credentials in order for you to make informed decisions. We do not, however, recommend any preferred or specific doctors/surgeons for your desired treatment. You agree to use the Website, the materials provided therein and avail Services only for the purposes that are permitted by the Terms of Use, and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

We reserve the right to either accept or refuse to provide our users all/any of the Services mentioned in Para 3.2 of this Terms of Use, as per Clause 4 of this Terms of Use. We may cancel any Services for any reason whatsoever by informing you of such cancellation any time prior to, or during rendering such Services. Further, we may cancel your scheduled consultation in case of non-availability of concerned doctor/surgeon and/or non-payment of consultation fees, by informing you of such cancellation any time prior to the scheduled consultation. It is solely our discretion to provide you with Services without any liability to you.

We reserve the right to add, delete, modify, change, suspend, discontinue and/or revise the method of providing Services through our Website or otherwise, or any features of our Services without any prior notice. However, we shall be not liable for any addition, deletion, modification, change, suspension, discontinuance and/or revision of services made by healthcare provider/ doctors, medical establishments, clinical labs, diagnostic labs, hospitals, post-operative care providers, or pharmacies.

Refusal to provide access to Website and/or Services:

We reserve the right to refuse access to our Website and/or refuse to provide you with our Services, if:

You misbehave with any or all of the employees/staff/authorised personal of “ PRAJIV VENTURES PRIVATE LIMITED ” and/or misbehave with any or all of the employees/staff/authorised personal of any of the authorised healthcare providers including but not limited contracted hospitals or clinical labs or diagnostic labs or post operative care operators and/or misbehave with any doctors/healthcare providers;
You misrepresent that you are the lawful guardian of a child below the age of 18 years and or you are authorised on behalf of any person not capable of providing consent or an employer to avail our Services and/or access our Website;
You fail and/or refuse to make payments with respect to any of your Services that you have availed and/or to any of the authorised healthcare providers including but not limited contracted hospitals or clinical labs or diagnostic labs or post operative care operators;
You interfere with the operation and management of “ ARORA HEALTH & WELLBEING ”(a unit of Prajiv Ventures Private Limited or any of the authorised healthcare providers including but not limited contracted hospitals or clinical labs or diagnostic labs or post operative care operators; or
You indulge in any activity prescribed under Clause 5.2 of the Terms of Use

Use of Website:

You hereby agree and acknowledge that you will use the Website for lawful and genuine purposes. You will not use the Website to harass other users or take any actions that will affect the availability or functionality of our Website or Services. You shall also not attempt to modify the features of the Website or any of its content. Any unauthorized attempts to modify or actual modification of any information stored on the Website shall result in appropriate legal action against you.

Data analytics: we may share information about you with authorised third parties hired to track the Website usage and analyse your information. Data analytics is performed in order to better understand usage of our Services and enhance the Website experience by helping us make better business decisions. However, all such third parties are subject to confidentiality obligations to reasonably protect your information.

In terms of Rule 3(2) of the Information Technology (Intermediaries Guidelines) Rules, 2011, you shall not host, display, upload, modify, publish, transmit, update or share any information which:

is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
harm minors in any way;
infringes any patent, trademark, copyright or other proprietary rights;
violates any law for the time being in force;
deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
impersonate another person;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation
